Retainer Fee and Payment
A non-refundable retainer fee for your session is due within ten (10) days after booking your session. This guarantees the time and date allotted for you (or due date held). Should a retainer fee not be received in this time frame, Mudpies N’ Butterflies Photography reserves the right to offer the date and time to another client. The retainer fee shall be applied to reduce the total cost and Client shall pay the balance due. Balance shall be paid in full at the session. Checks are preferred at location shoots.. Once payment is received, the process of editing your gallery begins. We pride ourselves in presenting completely edited-to-perfection images on delivery of your convenient online gallery.
Your retainer fee will be applied to your shoot. There is no editing fee; however should you request extra edits, digital upgrade or custom-designed invitation or announcement design fees are an additional fee.
Purchase
Although Mudpies N’ Butterflies has NO print order commitment for our sessions, you are required to use our very fairly priced professional lab for all large format printing via your convenient SmugMug ordering LINK. This ordering link is the fastest method of printing your images as they are matched to our perfectly-edited finished images for color correction, crop, and quality — and delivered directly to your door.
If your session fee includes wall art canvases, please make your selection within five (5) days of receipt of your finished gallery this ensures a timely delivery of your stunning art, as we order bi-weekly from our professional supplier. Although prints and canvases can be selected any time from your gallery in the future up to one year — your option for additional canvas art is at a discount when ordering multiple canvases at once, so consider selecting one of our pre-scaled collages or any additional canvas orders within the same timeframe.
Caring for Your Art
Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes or environment as well as media which may deteriorate.. Client releases Photographer from any liability for any claims whatsoever based upon the deterioration due to such events. You are responsible for the care and maintenance of your art. Upon receipt of your images, you release Mudpies N’ Butterflies Photography from any liability due to loss or damage of the images, and also release Mudpies N’ Butterflies Photography from any obligation to maintain copies of any digital file, image, or photo.
All Sales are Final
Due to the custom nature of each session, all sales are final.
Re-Shoots
Re-shoots are at the discretion of the Photographer, and are not provided for regretful choices such as clothing choices, a bad hair day, or behavior. We certainly understand children, and we pride ourselves in being child-photographer certified experts (who RARELY are unable to capture children at their very best). Re-shooting family sessions due to illness is considered, however not for behavior. WEATHER cancelation is also up to your photographer, as we know our professional capabilities in situations for elements.
Feeling Under the Weather
If you are feeling ill, please call to reschedule. If you must cancel, please try to kindly do so at least 24 to 48 hours before your session. Your retainer fee will be applied to a future session date.
Travel Fee
There is a minimum $50 travel fee for locations 15 miles outside of either of our studio locations.
Payment Options
Mudpies N’ Butterflies Photography accepts cash, credit card, and Paypal. If paying on a payment plan, a 3% charge will be added to your balance.
Copyright and Reproduction
Mudpies N’ Butterflies Photography shall own the copyright in all images created and reserves the right to use the negatives and/or reproductions for publication, portfolio, advertising, or display within or outside the Photographer's studio. Negatives, raw images, and edited images remain the property of Mudpies N’ Butterflies Photography.
Client's Usage
Client shall not modify, edit, reproduce, copy, or manipulate the copyrighted images in anyway without the written permission of Mudpies N’ Butterflies Photography. You have the permission to use the prints for personal use only; you do not have permission to sell said prints or to make copies of the images unless processing digital released images from your session that states size parameters… Any reproduction, display, distribution, and/or use of the copyrighted images for advertising or commercial use shall be allowed only upon Mudpies N’ Butterflies written permission specifying usage and fees. Any infringements of this copyright policy may be punishable by law with fines starting at $150,000.
